An Illinois state prosecutor announced today Kyle Rittenhouse won’t be charged with gun crimes in his home state. Rittenhouse is accused of fatally shooting two demonstrators and injuring a third in Kenosha, WI in August.

Lake County, Ill. State’s Attorney Michael Nerheim’s office released the following statement on the investigation:

“To that end, the investigation revealed the gun used in the Kenosha shooting was purchased, stored, and used in Wisconsin. Additionally, there is no evidence the gun was ever physically possessed by Kyle Rittenhouse in Illinois.”

Despite no charges coming in Illinois, Kyle remains in a juvenile detention center in Lake County without bond. Kyle still has pending criminal charges in Kenosha — where the shooting took place. The 17-year old is facing six criminal counts including first-degree intentional homicide.

Kyle Rittenhouse used an AR-15-style rifle during a protest in the city. He is accused of killing two and harming another. The protest erupted after the shooting of Jacob Blake. The attorney for Kyle stated his client never carried the gun across state lines and had it in his possession for protection.

Rittenhouse will appear in court for an extradition hearing on Oct. 30.
